I’m trying to use one of the cafe backgrounds where I can place someone behind the counter, but when I try to put someone in front of the counter using this background, it doesn’t work.
There is no separate overlay for the counter so I’m not sure what to do : (
You have to make an overlay for the counter. Then make sure the character the is in front of the counter is a layer above the counter overlay

The overlay is built into the background, so to have a character in front of the overlay while another character is behind it you will have to layer the overlay. To do this you need to use the background name as the overlay name to layer it.
