The overlay is built into the background, so to have a character in front of the overlay while another character is behind it you will have to layer the overlay. To do this you need to use the background name as the overlay name to layer it. BACKGROUND NAME with BACKGROUND NAME to layer #

You have to make an overlay for the counter. Then make sure the character the is in front of the counter is a layer above the counter overlay
